DMV Showdown Official Rules

1. NO PURCHASE NECESSARY TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. DMV Showdown Presented by Capital Business Unit DMV (the “Tournament”) is sponsored by Lincoln NBA 2K LLC d/b/a Wizards District Gaming (“WDG”), Capital Business Unit (“Capital Business Unit”) (collectively, the “Tournament Parties”) and administered by Rival Games, LLC (“Rival”) (together with WDG, the “Administrator”).  

 

1. Tournament is only offered in select zip codes within the District of Columbia, Maryland and Virginia (the “Tournament Area“). Visit the Tournament Page (below) for the complete list. Void outside the Tournament Area and where prohibited. 

 

1. Tournament is subject to all federal, state, provincial and local laws. Administrator shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding Registrations (defined below), registration or other deadlines, selection of winner, prize restrictions, and eligibility — and all its decisions are final and binding in all Tournament-related matters. By participating, you irrevocably, fully and unconditionally agree to be bound by these Official Rules and the decisions of Administrator and waive any right to claim ambiguity in these Official Rules or any other Tournament-related advertising or materials.  

GENERAL 

 

1. Tournament will consist of two (2) stages (each a “Stage”), described in greater detail in the sections below. All times in these Official Rules refer to Eastern Time (“ET”). Specific competition start and end times will be posted on the Tournament Page (below). Generally,  

1. Stage I: Registration Period: Registration begins on March 19, 2021. Registration closes on March 26, 2021 at 11:59 PM ET or when thirty-two (32) players (each, a “Player”) have completely registered, whichever occurs first (the “Registration Period”). Tournament will involve up to thirty-two (32) Players. You may register and participate as a Player only once during the Tournament. See “Registration Period” Section for more registration details. 

1. Stage II: Tournament Rounds: Registered Players will compete in the single-day Tournament on March 27, 2021. All Tournament Rounds will be single-elimination format matches (each a “Match”) and all Matches will be best-of-three (“BO3”) game (“Game”) format. Administrator’s computer is the official time-keeping device for the Tournament. See “Tournament Rounds” Section for more details.

PRIVACY 

 

1. Tournament is in no way sponsored, endorsed or administered by, or associated with, NBA Entities (defined below), Sony Interactive Entertainment, Inc. (“Sony Interactive”), or Take-Two Interactive Software, Inc. d/b/a 2K Sports (“2K”). You are providing information to Administrator and not to Sony Interactive or 2K. Any questions that you have about this Tournament must be directed to Administrator and not to the NBA Entities, Sony Interactive or 2K.  

 

1. The information you provide will only be used for administration of the Tournament and as otherwise set forth in these Official Rules. Rival collects the information necessary for it and WDG to operate the Tournament at the time a Player registers his/her Rival Account (below) and Gaming Account (below) and information collected from each Player will be shared with WDG. Without limiting WDG’s and Rival’s rights under their respective Privacy Policies (below), WDG and Rival may use such information to contact a Player for matters and events related to the operation of this Tournament. 

 

1. Players agree that WDG, Rival, and their respective agents, affiliates, subsidiaries, representatives or service providers may use Players’ personal information submitted with entry or Registration for purposes of future marketing by WDG and/or Rival, such as to notify them of a product or promotion that WDG and/or Rival think may be of interest. Please refer to WDG’s and Rival’s Privacy Policies at the websites referenced below for information about the choices that may be available to you to opt out of such promotional communications.  

 

1. Privacy Policies: By participating in this Tournament, you agree to the terms of the following privacy policies below, which may be updated from time to time: 

 

1. WDG: Visit https://www.nba.com/news/privacy_policy.html to review WDG’s current privacy policy (the “WDG Privacy Policy”); and 

 

1. Rival: Visit https://www.rivalgames.com/privacy-policy to review Rival’s current privacy policy (the “Rival Privacy Policy”). 

ELIGIBILITY 

 

1. To be eligible, each Player must satisfy each of the following eligibility requirements throughout the duration of the Tournament: 

 

1. He/she must be eighteen (18) years old or older and a legal resident of the Tournament Area; 

 

1. He/she must not be a current member of the NBA 2K League (below) or any team designated as “Official” or “Representative” WDG teams; and 

 

1. He/she must not be an employee, officer, director, agent or representative of any of the Excluded Entities (below), or a member of the immediate family (spouse, parent, child, sibling or in-law) or household member of any such persons. The term “household” includes all persons residing together in a single residence, whether or not related. 

 

1. For eligibility purposes above, the term “Excluded Entities” means: 

 

1. WDG, 

1. Lincoln Holdings LLC d/b/a Monumental Sports & Entertainment (“MSE”), 

1. Rival, 

1. Capital Business Unit, 

1. 2K, 

1. Visual Concepts Entertainment (“Visual Concepts”), 

1. Washington Bullets LP d/b/a Washington Wizards® (“Wizards”), 

1. Anacostia Sports LLC (“Anacostia”), 

1. Monumental Sports Network LLC (“Monumental Sports Network”), 

1. Washington Sports & Entertainment LP (“WSE”); 

1. Monumental Network LLP (“Monumental Network”); 

1. DC Arena LP (“DC Arena”); 

1. Capital One Arena (“Capital One Arena”); 

1. NBA Entities (as defined below), 

1. NBA® 2K League, LLC (“NBA 2K League”), 

1. Any prize provider(s); and  

1. Any other entity directly involved in the development or administration of the Tournament. 

 

1. Tournament is not open to groups, clubs or organizations. Groups, clubs and organizations are prohibited from reproducing or distributing the Tournament materials to their members without WDG’s prior express consent. 

 

1. The term “NBA Entities” means the National Basketball Association (“NBA”), NBA Properties, Inc., NBA Media Ventures, LLC, NBA Development League Holdings, LLC (f/k/a NBDL Holdings, LLC), WNBA Holdings, LLC (f/k/a NBA Development, LLC), WNBA, LLC, WNBA Operations, LLC, WNBA Enterprises, LLC, Planet Insurance Ltd., any successor or affiliate of any of the foregoing entities and any other entity in which a majority of the members directly or indirectly hold equity interests. 

 

1. The term “NBA Family” means the NBA, the Women’s National Basketball Association (“WNBA”), the NBA Gatorade League (“G-League”), the NBA 2K League, their respective teams, and each of their respective affiliates. 

 

1. ANY PLAYER WHO IS FOUND TO BE INELIGIBLE OR IS DISQUALIFIED AT ANY STAGE OF THE TOURNAMENT MAY NOT PROCEED TO THE NEXT ROUND OF THE TOURNAMENT AND, IF APPLICABLE, MAY BE REQUIRED TO RETURN ANY PRIZE AWARDED AND RECEIVED, OR ITS CASH EQUIVALENT, IN FULL WITHIN THIRTY (30) DAYS OF NOTIFICATION BY ADMINISTRATOR. 

PRIZE & PRIZE RESTRICTIONS 

 

1. Prize (1): Capital Business Unit gift cards and assorted Capital Business Unit and WDG-branded merchandise and in invitation (the “Invitation”) to play with one of the WDG players in the NBA 2K League Three For All Showdown on April 9 and 10, 2021 (the “Showdown”). Invitation has no cash value. ARV: $450.00. 

 

1. The likelihood of winning will depend on the combined skill of each Player and the number of Players registered to participate in the Tournament. 

 

1. All prize details shall be at WDG’s sole discretion. Winner assumes sole responsibility for all expenses and incidental costs associated with the prize not explicitly outlined above, including without limitation, all federal, state and local taxes (if any), or fees and surcharges. Any person who wins prizes through any WDG-sponsored promotions with cumulative value equal to or greater than $600 in a calendar year will receive an IRS 1099 MISC Form or other required tax document(s). 

 

1. Invitation component of prize has no cash value and is subject to the sole discretion of WDG and/or the NBA 2K League. If this prize element is unavailable or cannot be or is not fulfilled for any reason, winner will not be entitled to any substitution, remuneration or alternate prize element. 

 

1. Invitation is subject to all NBA 2K League rules, regulations, policies and restrictions. Showdown date and time are subject to change in sole discretion of NBA 2K League. Winner agrees to comply with all applicable NBA 2K League regulations and policies in connection with Showdown. NBA 2K League reserves the right to block, eject or otherwise deny access to any person, including winner, who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other participant during Showdown. Released Parties (as defined below) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of Showdown. Invitation is only valid for Showdown event as set forth above in the prize description.  

 

1. Prize or prize components are not exchangeable or redeemable for cash, may not be sold, bartered or auctioned, and must be accepted as awarded, without substitutions. The right to receive prize is personal to winner and not transferrable. Prize (in whole or part) not used or accepted by winner is forfeited and no cash or substitute will be offered or permitted, unless required by law. Prize may not be substituted except that WDG in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.  

 

1. Winner will receive further instructions with respect to Invitation component of prize. Merchandise and gift card components of prize will be shipped to the winner following verification by Administrator. Please allow up to ninety (90) days for delivery. Prize is provided “as is” with no warranty or guarantee either express or implied by Released Parties (defined below). Released Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prize. Other restrictions apply. 

STAGE I – REGISTRATION (3/19/2021 – 3/26/2021) 

 

1. Registration begins on March 19, 2021 at 1:00 PM ET and ends when thirty-two (32) Registrations have properly completed and received by Administrator, or March 26, 2021 at 11:59 PM ET, whichever occurs first. Registration requires satisfaction of certain conditions. 

 

1. Prior to registering for the Tournament, you must have: 

1. a PlayStation®Plus account (a “Gaming Account”),  

1. a PlayStation® Network ID (your ID or user name for the PlayStation®Plus account (“Gaming ID”),  

1. access to a PlayStation®5 system (a “Console”), and  

1. a copy or game valid license of NBA® 2K21 (“NBA 2K”) for the Console.

1. Your participation in the Tournament is further subject to the applicable terms of service and privacy policies (each, “Gaming Account Policies”) published by the Gaming Account. You can view the Gaming Account Policies by visiting https://www.playstation.com/en-us/legal/terms-of-use (Sony Interactive Terms of Service) and https://www.playstation.com/en-us/network/legal/privacy-policy/ (Sony Interactive Privacy Statement).  

 

1. In order to participate, you must also have a current Rival Gaming account (a “Rival Account”) in good standing and access to the Internet. There are no fees or service charges to create or maintain a Rival Account, which you may create for free by visiting http://www.rivalgames.com and following the provided instructions.  

 

1. Participation is subject to the Rival terms of service (the “Rival Terms”) (https://www.rivalgames.com/terms-of-service) and privacy policy (https://www.rivalgames.com/privacy-policy). 

 

1. Your Rival Account must remain in good standing during the entire Tournament to remain eligible. Administrator reserves the right at any time during the Tournament to disqualify any Player from further participation or eligibility for prize, and/or to require the return of any prize received, if Administrator determines, in its sole and absolute discretion, that such Player’s Rival Account has been suspended or is subject to suspension based on Player’s violation of applicable Rival Terms, including (a) providing false information or bypassing any age gate or similar restrictions to create a Rival Account, (b) harassing other Players and/or Rival employees; engaging in suspected or confirmed fraud or unfair gameplay. You agree and acknowledge that such disqualification may be declared at any time during the Tournament, even if you have proceeded through one (1) or more Matches.  

 

1. In addition, Administrator reserves the right in its absolute discretion to refuse Registration or participation by any Player whom it reasonably believes is currently engaging or has previously engaged in abusive, hateful, racist, threatening, bullying, harassing, unsportsmanlike, offensive or other inappropriate conduct or speech targeting or directed at other Players, participants or Tournament staff, which conduct Administrator reasonably believes in its sole and absolute discretion would negatively impact the proper and fair operation/administration of the Tournament or reflect negatively on goodwill or reputation of the Tournament or any of the Released Parties.  

 

1. Administrator reserves the right to require any Player (including any Finalist) to present proof that of satisfaction (or continued satisfaction) of all eligibility requirements above, to disqualify any such Player who does not present adequate documentation, as determined by Administrator in its sole discretion and at any time during the Tournament. 

 

1. All potential Players must first register as users before registering for the Tournament. To register, visit the Tournament Page at <<TOURNAMENT PAGE URL>> and follow the steps to complete an official individual registration form with all required information, which may include name, gamer tag (“Gamer Tag”), avatar (“Avatar”), e-mail address, telephone number, mailing address, and age or date of birth.  

 

1. Next, follow the instruction to navigate to the Tournament Page, locate the relevant Tournament and select “Join Tournament.”  

 

This is the only method of registration. Registrations will not be accepted via U.S. mail, e-mail, or any other method.  

 

1. All Registrations must be completed in their entirety and received by Administrator no later than March 26, 2021 at 11:59 PM ET. Proof of submission is not proof of completion or receipt. Administrator will not accept screen shots as proof of Registration. 

 

1. IMPORTANT: DATA RATES MAY APPLY TO USE OF MOBILE PHONE/DEVICE TO PARTICIPATE IN THE TOURNAMENT. 

 

1. Limit one (1) Registration per person. Additional Registrations received from any such person thereafter will be subject to disqualification. Any use of robotic, repetitive, automatic, programmed, mechanical, script, macro, or any other automated means or similar registration methods or agents (including, but not limited to, contest-entry services or multiple or different e-mail addresses, or the submission of false contact information under multiple or different e-mail addresses, identities, Registrations, accounts or logins) or any other devices or artifices to register or encourage, directly or indirectly, multiple or false Registrations are prohibited and suspected or detected registration method violations may result in the Player’s disqualification, in Administrator’s sole discretion. No group submissions will be accepted. 

 

1. Each Player is responsible for submitting the correct in–game Player name to the Rival platform and to update it in the event it is inaccurate. Failure to input correct in–game name may result in disqualification. Each Player must use the same Rival Account and Gamer Tag for the entire Tournament. Players may not use multiple Gaming IDs during the Tournament (i.e., Players are prohibited from using multiple Gaming IDs to participate more than once in the Tournament). 

 

1. Each Registration must be associated with a valid Rival Account, Gaming Account and Gaming ID and must include a valid e-mail address and telephone number for that Player. Administrator is not responsible for voice or electronic communications that are undeliverable because of any form of call blocking of any kind or inability to leave a voice message, or any form of passive, or as to e-mail, active filtering of any kind.  

 

1. In the event of a dispute as to the identity or eligibility of a Player based on a Rival Account or Gaming Account, the Registration will be deemed made by the “Authorized Account Holder” of the relevant Rival Account or Gaming Account, as applicable, used for Registration. The Authorized Account Holder is the natural person who is assigned to the Rival Account by Rival or to the Gaming Account by Sony Interactive, as applicable. In the event of a dispute as to the identity of any Player, such Player agrees to furnish requested documentation confirming his/her status as the Authorized Account Holder. 

 

1. Any additional requested Registration fields are required for the Tournament. Players who fail to provide any required information may be disqualified at the discretion of Administrator without further notification. Administrator is not responsible for Registrations that are lost, misdirected, undelivered, garbled, distorted, truncated, incomplete, illegible, incorrect or late for any reason, and all such Registrations are void. Administrator reserve the right in its sole discretion to disqualify any Registration at any time that in its opinion does not comply with these Official Rules. Registrations become the property of Administrator and will not be returned or acknowledged. 

 

1. Your Gamer Tag and/or Avatar must comply with the terms and conditions at the Tournament (the “Website Terms”) as well as the following content restrictions: Gamer Tags and Avatars must not depict or include any identifiable individuals, brand names, trademarks, logos or trade names and must not include any content, language or images that would make them inappropriate for publication or broadcast to a general audience as determined by Administrator in its absolute and sole discretion. Without limiting the foregoing, Gamer Tags or Avatars that include foul language, nudity or other states of undress, graphic or excessively violent content, lewd, pornographic, obscene, indecent, hateful, tortious, illegal, defamatory, slanderous, libelous, false, or disparaging content, or that content invades any person’s privacy or other rights, or that promotes or advocates drug use, bigotry, racism, hatred, or harm against any group or individual, or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or that appears to violate any third-party intellectual property rights, as determined by Administrator in its absolute and sole discretion, may be subject to mandatory replacement or disqualification.  

 

1. Administrator may reject any Registration or disqualify any Player (or require replacement of the associated Gamer Tag and/or Avatar in its sole discretion) if it determines that such Registration, Player and/or Gamer Tag or Avatar has violated the Official Rules (including these content restrictions), or is otherwise unsuitable, offensive, or in poor taste, at any time. You agree that Administrator has the sole discretion to decide whether any Registration, Gamer Tag or Avatar satisfy these Official Rules and that its decisions are final. WITHOUT LIMITING THE FOREGOING, ADMINISTRATOR RESERVES THE RIGHT TO REJECT OR REQUIRE REMOVAL OR REPLACEMENT OF ANY GAMER TAG AND/OR AVATAR AND/OR DISQUALIFY THE RELEVANT PLAYER IT DEEMS, IN ITS SOLE, SUBJECTIVE DETERMINATION, TO BE INAPPROPRIATE WITHOUT ANY OBLIGATION TO ENGAGE IN ANY COMMUNICATION, COMMENT OR DISCUSSION ABOUT ANY SUCH GAMER TAG/AVATAR OR PLAYER AND/OR ANY DECISION TO REMOVE SUCH GAMER TAG/AVATAR AND DISQUALIFY THE CORRESPONDING PLAYER. ALL DECISIONS OF ADMINISTRATOR ARE FINAL. 

 

1. By submitting a Registration with a Gamer Tag and/or Avatar, you expressly grant to WDG and Rival (and to those acting on behalf of either WDG or Rival) a non-exclusive, perpetual, irrevocable, world-wide royalty-free license (and waive all moral rights in and to the Registration, Gamer Tag and/or Avatar) to display, reproduce, distribute, publish, perform, edit, otherwise use the Registration, Gamer Tag and/or Avatar for advertising and promotional purposes, including the display of the Registration, Gamer Tag and/or Avatar on their respective websites, Facebook and/or Twitter pages, Instagram and/or Pinterest channels and/or any other social media platforms in connection with this Tournament. For clarity, WDG and Rival have the right (but not the obligation) to publish any Registration, Gamer Tag and/or Avatar on their respective websites and/or social media channels and as they otherwise so choose. 

 

1. By submitting a Registration with a Gamer Tag and/or Avatar, you warrant that (a) you are legally entitled to submit the Registration, Gamer Tag and/or Avatar in the Tournament, (b) the Registration, Gamer Tag and/or Avatar do not infringe any third-party rights, (c) the Registration, Gamer Tag and/or Avatar comply in all respects with the Official Rules and Website Terms, and (d) you agree to indemnify and hold Released Parties (defined below) harmless from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by you of these Official Rules or the warranties and/or representations made by you pursuant to these Official Rules. 

 

STAGE II – TOURNAMENT ROUNDS (3/27/2021) 

 

1. All Tournament Rounds will be held on March 27, 2021, as follows.  

 

1. Round-of-32: The Round-of-32 will be held on March 27, 2021 starting at 1:00 PM ET. The sixteen (16) winning Players will progress to the Round-of-16 as the Round-of-16 Players. 

 

1. Round-of-16: The Round-of-16 will be held on March 27, 2021 following the conclusion of the Round-of-32. The eight (8) winning Round-of-16 Players will progress to the Quarterfinal Round as the Quarterfinalists. 

 

1. Quarterfinal Round: The Quarterfinal Round will be held on March 27, 2021 following the conclusion of the Round-of-16. The four (4) winning Quarterfinalists will progress to the Semifinal Round as the Semifinalists. 

 

1. Semifinal Round: The Semifinal Round will be held on March 27, 2021 following the conclusion of the Quarterfinal Round. The two (2) winning Semifinalists will progress to the Final Round as the Finalists. 

 

1. Final Round: The Final Round will be held on March 27, 2021 following the conclusion of the Semifinal Round. Subject to verification of eligibility (see Winner Verification / Publicity Release below) and ongoing compliance with the Official Rules, the winning Finalist will be declared the winner. 

 

1. All dates, times, and locations are subject to change. If there is a change to the date, time and/or location of any event, Administrator will use reasonable efforts to notify all affected Players at least seventy-two (72) hours prior to the date of the relevant event. 

 

1. Administrator will not be responsible for weather, acts of God, acts of terrorism, civil disturbances, labor or other strike or work stoppage, or any other natural disaster outside its control that may cause the cancellation or postponement of the Tournament or any part thereof or any other inability to conduct the Tournament or any part thereof as scheduled. 

FORMATS & PROCEDURES 

 

1. The following general conditions will apply to Match play unless otherwise specifically described on the Tournament Page or the Administrator Match Page (defined below).  

 

1. All Matches will be played in BO3 Game format. The initial bracket will consist of thirty-two (32) Players and the initial Matches will be seeded on a random basis determined by Administrator in its discretion.  

 

1. PS5 Consoles will be used exclusively during the Tournament, and all Matches must be played on PS5 Consoles. Game procedures and settings for all Matches are determined by Administrator and published on the Tournament Page. 

 

1. Players are prohibited from using racist, sexist, hate-speech, or otherwise inappropriate language or behavior at any time during Match play. All Match play is subject to monitoring by Administrator. Any disputes, glitches or complaints during any Match will be referred to and resolved by Administrator. Administrator reserves the right in its sole discretion to determine whether reported or observed incidents violate the rules and the appropriate consequences. If Administrator determines that a Player has engaged in unsportsmanlike behavior or any form of cheating, Administrator in its discretion may impose penalties on that Player ranging from forfeit of a Game to disqualification from the Tournament. 

 

1. A notice will be posted on the Tournament Page with the list of initial Matches. Players must check in and confirm their participation in accordance with all deadlines posted by Administrator on the Tournament Page for each Match. Players are solely responsible for checking the Tournament Page to determine the start time for each Match and the corresponding check-in deadline. Failure of any Player to timely check in and confirm participation in a scheduled Match may result in that Player’s forfeiture of the relevant Match. 

 

1. In the event that any Player is disqualified for any reason prior to the conclusion of the Final Round, the disqualified Player will forfeit all remaining Matches, which will be treated as byes for the remainder of the Tournament.  

 

1. Match communication with opponents will occur on the Administrator match page (the “Administrator Match Page”) for each respective Match. Tournament support will occur on the official Tournament Discord support server. Please post Tournament questions in the designated support channels in the Discord support server. Official Discord links can be found on the Tournament contact page.  

 

1. Score reporting will occur on the Administrator platform. The winning Players in all Games and Matches must capture screenshots of all end game screens. The winning Player should report the score of the Match immediately after it has been played.  

WINNER VERIFICATION / PUBLICITY RELEASE 

 

1. The potential winner may be required to present valid photo identification and/or to sign an affidavit or declaration of eligibility, liability waiver, publicity release (where legal), tax forms and/or other legal documents (“Verification Paperwork”) and to provide such documents to Administrator within seventy-two (72) hours of initial notification and as a condition of receiving the prize. Administrator in its sole discretion may allow for transmission of Verification Paperwork via fax or e-mail. 

 

1. If the potential winner fails to satisfy any eligibility or verification requirement herein or is otherwise determined to be ineligible, Administrator in its discretion may disqualify that potential winner and the remaining Finalist will be declared the alternate potential winner, subject to verification of eligibility.  

 

1. WDG, Rival, and Capital Business Unit may, in their sole discretion, post the verified winner’s name on the Tournament Page and/or any of WDG’s, Rival’s or Capital Business Unit respective websites, including https://wizardsdg.nba.com and http://www.rivalgames.com, and on or in any of WDG’s, Rival’s and Capital Business Unit respective social media pages or channels and broadcast it on any of WDG’s stations. 

 

1. By accepting prize, winner agrees to award WDG and Rival the right to publicize his or her name, photographs (including the use and appearance of his or her photograph on WDG’s and Rival’s respective websites), likeness, biographical information, e-mail address, voice and details of winning and/or participation for purposes of this and future promotions without further compensation, except where prohibited. 

MISCELLANEOUS 

 

1. WDG reserves the right to cancel, suspend or terminate this Tournament, or any part thereof, if WDG determines, in its sole discretion, that the security, administration, fairness and/or operation of the Tournament has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, regularly-scheduled maintenance, malfunction, or any other cause beyond Administrator’s control. In such an event, Administrator will post notice of same at the Tournament and determine the winner from all non-suspect Registrations received prior to the suspension, cancellation or termination of the Tournament in accordance with the above-described selection procedures or in such other manner as WDG, in its sole discretion, deems fair and appropriate under the circumstances.  

 

1. Administrator reserves the right to disqualify any individual from further participation in the Tournament if Administrator concludes, in its sole discretion, that such person (a) has attempted to tamper with the registration process or other any operation of the Tournament, (b) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (c) has acted towards WDG, Rival, Tournament officials, or any other Player or participant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to participate more than the number of times permitted herein, including by using any prohibited device or method. Any failure by Administrator to enforce any of these Official Rules shall not constitute a waiver of such Official Rules. 

 

1. ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND ADMINISTRATOR RESERVES THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT FOR PROSECUTION TO THE FULLEST EXTENT PERMITTED BY LAW. 

 

1. All activity arising out of and relating to the Tournament, including any reference to the status of any Player as a “winner” is subject to verification and/or auditing for compliance with the Official Rules. If Administrator determines, in its sole discretion, that verification or auditing activity evidences non-compliance of any Player with the Official Rules, Administrator reserves the right to disqualify such Player from the Tournament and any prize at any time. Administrator reserves the right to conduct a background check on potential winner and to disqualify any individual based on such background check if Administrator determines in its sole discretion that awarding a prize to any such individual might reflect negatively on WDG or Capital Business Unit. Each Player agrees to cooperate with WDG and its representatives in connection with all verification, auditing and/or background check activities. 

 

1. Administrator reserves the right to correct typographical, printing or clerical errors in any Tournament-related materials. No more than the stated number of winners will be selected. If production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, WDG reserves the right to select only the stated number of winners from among all legitimate, un-awarded, eligible prize claims in accordance with the previously described selection method or as it deems fair under the circumstances. Administrator reserves the right to declare fewer than the stated number of winners if it does not receive an adequate number of properly submitted and eligible Registrations. 

LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES 

 

1. By playing, accepting a prize or otherwise participating in the Tournament, you agree that WDG, MSE, Rival, Capital Business Unit, Wizards, Anacostia, Monumental Sports Network, 2K, Sony Interactive, Visual Concepts, WSE, Monumental Network, DC Arena, Capital One Arena, the NBA Entities, NBA 2K League, Capital One Bank (USA), N.A., Facebook, Inc. (“Facebook”), Twitter (“Twitter”), Instagram, Inc. (“Instagram”), any other company involved in the development or administration of this Tournament, and a range of subsidiaries, agencies, affiliates, franchisees, promoters, prize suppliers, directors, officers, employees, agents and related persons (collectively, the “Released Parties”): (a) are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including but not limited to: failed, incomplete, misdirected, corrupted, garbled or delayed transmissions, telephone connections, traffic congestion on telephone lines, the Internet or at any website; or disconnected, interrupted, or unavailable network, server, or other connections; or late, lost, undeliverable, damaged or stolen mail; or other errors of any kind, whether human, mechanical, or electronic; or Registrations that for any reason are not properly submitted or received by Administrator by any deadline stated above; (b) are not responsible for any incorrect or inaccurate information, whether caused by Players or other participants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Tournament or in the printing of this offer, administration of this Tournament, or in the selection or announcement of the winner or prize; (c) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in the Tournament or downloading of any software or materials; (d) are not responsible for unauthorized human intervention in any part of the Tournament; (e) are not responsible for any unauthorized third–party use of any Registration materials (including any Avatars or Gamer Tags); (f) are not responsible for the inability to select the winner because of postal failure, equipment failure, or data storage failure; and (g) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Tournament, the acceptance of registrations, the selection of the winner, or otherwise in any Tournament-related materials. 

 

1. RELEASED PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE PRIZE. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE TOURNAMENT OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF A PRIZE OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE TOURNAMENT OR RELATED WEBSITES OR MOBILE PLATFORMS, OR ANY OF THEIR RESPECTIVE FEATURES OR FUNCTIONALITIES, WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE TOURNAMENT.  

 

1. By playing, accepting a prize or otherwise participating in the Tournament, you agree to release and hold Released Parties harmless from all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, relating to or arising from, in whole or in part, directly or indirectly, (a) your participation or inability to participate, in the Tournament or any Tournament-related or prize-related activity; (b) the use (including modification, adaptation, and reproduction) by Released Parties of Registration materials (including any Avatars or Gamer Tags) during or after the Tournament; (c) the delivery, acceptance, possession, redemption, use, misuse, loss, or misdirection of the prize; and (d) any other claim or cause of action you may have against any Released Party. If, for any reason, any individual’s Registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, that individual’s sole remedy is another Registration, if it is possible. 

 

1. BY PLAYING, ACCEPTING A PRIZE OR OTHERWISE PARTICIPATING IN THE TOURNAMENT, YOU FURTHER AGREE THAT (A) ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE TOURNAMENT OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE TOURNAMENT, BUT IN NO EVENT ATTORNEYS’ FEES; AND (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED AND ANY DAMAGES OTHER THAN ACTUAL OUT-OF-POCKET COSTS DESCRIBED ABOVE. 

 

1. SOME STATES DO NOT ALLOW LIMITATIONS ON THE ABILITY TO PURSUE CLASS ACTION REMEDIES, OR ON CERTAIN KINDS OF DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART. 

DISPUTES 

 

1. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Players, other participants or Released Parties in connection with the Tournament, shall be governed by Virginia law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Virginia. 

 

1. Arbitration: Except where prohibited by law, by participating and/or accepting a prize in the Tournament, you expressly agree that (a) any and all disputes and causes of action arising out of or connected with this Tournament, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and held at the AAA regional office nearest to you; (b) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (c) judgment upon such arbitration award may be entered in any court having jurisdiction. 

 

1. By playing, accepting a prize or otherwise participating in the Tournament, you expressly (a) agree that any non-arbitrable legal proceedings arising out of or relating in any way to this Tournament or these Official Rules shall be brought only in the federal or state courts located in Virginia, and (b) consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings. 

 

1. In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Tournament-related materials, including but not limited to the Registration forms, or point of sale, television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control. If any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 

 

NON-AFFILIATION 

 

1. Tournament is in no way sponsored, endorsed or administered by, or associated with the NBA Entities, Sony, 2K, Facebook, or any of their respective parents, owners, subsidiaries, affiliates, directors, officers, shareholders and agents and each of them is completely released of all liability by each participant in the Tournament. Any questions, comments or complaints regarding the Tournament must be directed to the Administrator and not to the NBA Entities, Sony, 2K, or Facebook.
